Dog Ownership in High-Rise Residential Buildings (Such as Condominiums or Apartments)

1.

Under the Dog Licensing and Dog Breeding Establishments (Federal Territory of Kuala Lumpur) (Amendment) By-Laws 2011, By-Law 8A "Small Dog in Flats", the Mayor may permit one small dog to be kept, harboured, or maintained in a flat.

2.

Under By-Law 2(b)"Small dog" means any dog as specified in Schedule II.
i. Minature Pinscher
ii. Bichon Frise
iii. Pekingese
iv. Papilon
v. Poodle (Toy)
vi.Japanese Chin
vii. Maltese
viii. Pomeranian
ix. Chihuahua

3.

Under By-Law 3(1) – No person shall own, keep, harbour, or maintain any dog unless the dog is licensed in accordance with these By-Laws.

4.

Under By-Law 3(2) – An application for a licence:
(a) shall be made to the Mayor in such form as may be determined by the Mayor;
(b) shall be accompanied by a fee of ten ringgit.

5.

An application for a small dog licence must be accompanied by a letter of consent from the Joint Management Body (JMC) or Management Corporation (MC) at the time of application.

6.

The dog kept must not cause any nuisance or create any unreasonable disturbance to other residents. Examples of such nuisance include:

i. The dog causing or contributing to damage to public property, or injury to residents within the residential premises.
ii. The dog barking continuously (whether by day or night), resulting in a noise disturbance to local residents.
iii. The dog being allowed to roam freely without supervision, or exhibiting aggressive, dangerous, or potentially harmful behaviour.

The dog must be confined to the owner's unit and must not be allowed to roam freely.

8.

The owner may only bring the dog out of the building using the lift service, and the dog must remain under the owner's supervision and control at all times.

9.

Dogs are not permitted to urinate or defecate in public areas. Should this occur, the owner is responsible for immediately cleaning up after their pet.

DOG LICENSING AND DOG BREEDING ESTABLISHMENTS BY-LAWS (FEDERAL TERRITORY OF KUALA LUMPUR) 1991 (AMENDMENT) 2011
STRATA TITLES ACT 1985 (ACT 318)

 

Pursuant to Paragraph 6(d) of the Third Schedule of the Strata Titles Act 1985 (Act 318), it is stated that:

A parcel owner shall not keep any animal in his parcel or on the common property if it causes nuisance to any other parcel owner.

Prohibition on Prohibited Dogs

DOG LICENSING AND DOG BREEDING ESTABLISHMENTS BY-LAWS (FEDERAL TERRITORY OF KUALA LUMPUR) 1991 (AMENDMENT) 2011

Under By-Law 8B (1), no person shall own, keep, harbour, or maintain any prohibited dog.

By-Law 2(d) – "Prohibited dog" means any dog as specified in Schedule III:

  • Pit Bull Terrier / Pit Bull (also known as the American Pit Bull, American Pit Bull Terrier, American Staffordshire Terrier, and Stafford Bull Terrier)
    1. American Bulldog
    2. Neapolitan Mastiff
    3. Japanese Tosa
    4. Akita
    5. Dogo Argentino
    6. Fila Braziliero

Under By-Law 8B (2), the Mayor shall seize and dispose of any prohibited dog found on any premises or found wandering in public areas.

Under By-Law 8B (3), no compensation shall be payable by the Mayor for the disposal of such dog.

Responsibilities of a Licensed Owner of a Controlled Dog

DOG LICENSING AND DOG BREEDING ESTABLISHMENTS BY-LAWS (FEDERAL TERRITORY OF KUALA LUMPUR) 1991 (AMENDMENT) 2011

 

Under By-Law 3(2) – An application for a licence:
(c) in the case of a controlled dog, shall be made only after –

  1. the applicant has attended and passed a dog handling course; and

  2. the dog has completed and passed the Canine Good Citizen programme conducted by a body approved by the Mayor.

 

Under By-Law 8C, a person who is granted a licence to own, keep, harbour, or maintain a controlled dog shall:

  1. Keep the dog under appropriate supervision at all times.

  2. Ensure that the dog is leashed and muzzled and remains under proper control at all times when taken out of the premises.

  3. Ensure that the dog does not roam beyond the premises in which it is kept.

  4. Ensure that the premises are securely fenced and that such fencing is properly maintained at all times.

  5. Display at all times a sign stating “BEWARE OF DOG” in a prominent and visible location at both the front and rear of the premises.

 

Under By-Law 2(c)Controlled dog means any dog as specified in Schedule IV.

6. Perro de Presa Canario ( juga dikenali sebagai Canary Dog )
